Our Mediation Services
We offer structured mediation services designed to assist parties in resolving disputes efficiently and constructively. Each matter is approached on its own merits, with the mediation process tailored to the nature of the dispute and the needs of the parties.
Private Mediation
Private mediation is a voluntary process in which parties engage an independent mediator to assist in resolving a dispute outside of court proceedings.
What private mediation offers:
- Flexible scheduling and process design
- Confidential discussions conducted without prejudice
- Greater control over outcomes
- Reduced cost and time compared to litigation
Private mediation may be initiated by one or both parties and is suitable for disputes at any stage, including before litigation has commenced or while proceedings are underway.
Court-Annexed Mediation
Court-annexed mediation is conducted in accordance with applicable court rules and procedures and forms part of the formal litigation process.
Key features of court-annexed mediation:
- Referral through the court process
- Independent facilitation by a trained mediator
- Opportunity to resolve or narrow issues prior to trial
- Structured process aligned with court requirements
Court-annexed mediation provides parties with an opportunity to explore settlement while preserving their legal rights.
Our Mediation Process
Pre-Mediation / Initial Engagement
A preliminary engagement with the parties to assess the nature of the dispute, determine suitability for mediation, explain the mediation process, and identify any issues requiring preparation before mediation begins.
Agreement to Mediate the mediation.
Confirmation of the mediation framework, including confidentiality, roles of the parties and mediator, and procedural guidelines governing
Mediation Session(s)
Facilitated discussions conducted in joint and/or private sessions, aimed at identifying key issues, exploring underlying interests, and considering practical settlement options.
FEES AND ENGAGEMENT
Mediation fees are determined based on the nature and complexity of the dispute, the duration of the mediation, and whether the matter is private or court-annexed. Fee structures are discussed upfront to ensure transparency.
